§ 609.26 — Depriving Another of Custodial or Parental Rights

It is a felony to hide a child from a parent, take or keep a child in violation of a custody order, refuse to return a child to a lawful custodian, or harbor a runaway or truant child. Penalties range from up to two years to up to four years in prison for aggravated cases. Defenses include reasonably believing the child needed protection from abuse.

Practical Notes
This law is commonly used in custody disputes where one parent refuses to return a child. Charges may be dismissed if the child is returned within 48 hours or a custody proceeding is started within seven days. An adult living with a minor under 16 without parental consent can also be charged. The costs of returning the child can be assessed against the convicted person.
