§ 609.324 — Patrons; Prostitutes; Housing Individuals Engaged in Prostitution; Penalties

Plain-Language Summary

This section sets penalties for patrons and prostitutes. Patrons who hire minors under 14 face up to 20 years in prison; those hiring minors 14-15 face up to 10 years; those hiring minors 16-17 face up to 5 years. Patronizing an adult prostitute is a gross misdemeanor with a minimum $1,500 fine. For prostitutes, acting in a public place is a gross misdemeanor, while other cases are a misdemeanor.

Practical Notes
Minnesota law treats patrons more harshly than prostitutes, especially when minors are involved. Repeat patrons face felony charges. People who let minors live with them knowing the minor is engaged in prostitution also face charges. Trafficking victims have an affirmative defense if they were forced into prostitution. A motor vehicle used in the offense can be noted on the patron’s driving record.
