§ 609.415 — Definitions

Plain-Language Summary

This section defines terms used in the public corruption statutes (bribery, misconduct, and related crimes). A 'public officer' includes elected officials, government administrators, judges, hearing officers, and law enforcement. A 'public employee' is anyone who works for or acts on behalf of state or local government but is not a public officer.

Practical Notes
These definitions are important because they determine who can be charged under the public corruption statutes. The definitions are broad and cover all levels of government, from state officials to local municipal employees. Even someone who has been elected or appointed but has not yet started the job is considered a public officer or employee.
