§ 609.495 — Aiding an Offender

It is a felony to help someone you know has committed a crime to avoid arrest, trial, or punishment. This includes hiding them, destroying evidence, providing false information, or receiving stolen proceeds. The penalty is up to three years in prison for harboring a felon. Obstructing an investigation can bring up to half the sentence of the underlying crime.

Practical Notes
This law covers being an accessory after the fact. It also makes it a crime to take the blame for someone else’s criminal act to obstruct justice. Helping someone who has violated their probation or parole can also be charged under this section.
