§ 609.583 — Sentencing; First Burglary of Dwelling

Plain-Language Summary

For a person convicted of first-time burglary of a dwelling where no one was home, the court may stay the prison sentence if the person has no prior burglary convictions and the court finds it is in the interest of the community and the defendant.

Practical Notes
This provision gives judges flexibility for first-time dwelling burglary offenders. It allows alternatives to prison such as probation with conditions. Repeat offenders and those who burglarized occupied homes are not eligible.
