2025 Session Last amended: 2021 session

§ 82.81 — Prohibitions

Plain-Language Summary

This section lists activities that are prohibited for real estate licensees in Minnesota. It is illegal to act as a broker without a license, misrepresent your license status, claim buyer deposits when a deal falls through due to the seller, or engage in various fraudulent practices. It also bars self-serving contract clauses and discouraging clients from using an attorney.

Practical Notes
If you are working with a real estate agent, know that they cannot force you to use a specific lender or attorney, discourage you from hiring a lawyer, or guarantee future profits. Agents must provide agency disclosure forms at the start of residential transactions.
