§ 13.10 — Data on Decedents

Plain-Language Summary

This section explains what happens to private and confidential data after a person dies. The data keeps its classification but the deceased person's representative (spouse, children, or parents) can exercise the data rights. After 10 years from death and 30 years from data creation, the data becomes public.

Practical Notes
If a family member has passed away and you need access to their private government data, you may have rights as their representative. A surviving spouse, child, or parent can request private data about the deceased. A court can also order release of a deceased person’s data if the public benefit outweighs the harm.
