§ 259.53 — Petition; Investigations; Reports

Plain-Language Summary

Requires a postplacement assessment and report within 90 days of an adoption petition being filed, evaluating how the child is adapting to the adoptive home. Also requires a three-month preadoption residence period and provides that adoption records are confidential. Prohibits denying adoption based on a prospective parent's disability.

Practical Notes
After you file your adoption petition, an agency must evaluate how the child is doing in your home and file a report with the court within 90 days. The child must live with you for at least three months before the adoption can be finalized. Stepparent adoptions may have these requirements waived. Importantly, a court or agency cannot deny your adoption solely because you have a disability.
