Plain-Language Summary

This section lists the agencies and situations where the Administrative Procedure Act does not apply. The APA does not cover legislative or judicial agencies, emergency powers, the Department of Military Affairs, the Comprehensive Health Association, or the University of Minnesota regents. Several other agencies are exempt from contested case procedures. Many types of internal agency actions, forms, and curriculum decisions are also exempt from rulemaking requirements.

Practical Notes
Before challenging an agency action under the APA, check whether the agency or type of action is exempt under this section. Unemployment insurance disputes, workers’ compensation cases, and several other proceedings follow their own separate procedures instead. Internal management rules, application forms, and agency curriculum requirements generally do not need to go through the formal rulemaking process.
