§ 14.15 — Administrative Law Judge's Report

Plain-Language Summary

After a rule hearing, the administrative law judge writes a report evaluating the proposed rule. There is a five-day comment period after the hearing, then a five-day rebuttal period. The report must be finished within 30 days. If the judge finds the rule was changed too much from the original proposal or was not properly justified, the agency must fix the problems before adopting the rule.

Practical Notes
After a rule hearing, you have five working days to submit additional written comments and then five more days for rebuttal. The judge’s report must be available for at least five working days before the agency takes further action. Minor procedural errors will be overlooked if they did not prevent meaningful public participation. If the judge finds the rule lacks sufficient justification, the agency must submit it to legislative committees for review.
