§ 14.38 — Effect of Adoption of Rules

Plain-Language Summary

A properly adopted and filed rule has the force of law five working days after its adoption notice is published in the State Register. Rules generally cannot be applied retroactively unless the law specifically allows it. Agencies must keep their rules current by amending or repealing rules within two years of statutory changes.

Practical Notes
A rule cannot be enforced against you for actions that happened before the rule took effect, unless a specific law allows retroactive application. If a statute changes, the agency has two years to update its rules. The Secretary of State keeps a permanent public record of all filed rules.
