§ 149A.01 — Purpose and Scope

This section explains that Minnesota law regulates how dead human bodies are handled, transported, and laid to rest. In general, you need a license from the commissioner of health to remove a body from the place of death, prepare it for burial or cremation, or arrange funeral services. Practical Notes
Family members with the legal right to control the body can transport, prepare (except embalming), and arrange final disposition without a license. Religious and cultural customs for washing and dressing the dead are also protected. Hospitals and other institutions may still require licensed personnel.
