§ 182.654 — Rights and Duties of Employees

Plain-Language Summary

Employees must follow workplace safety standards. They have the right to participate in setting standards, be notified of variance requests, access safety information, and refuse to work under conditions they reasonably believe will cause death or serious harm. Employees cannot be fired or punished for reporting safety concerns.

Practical Notes
This section protects workers who speak up about unsafe conditions. If you refuse dangerous work in good faith and the commissioner confirms the danger, you are entitled to continued pay. An employer who retaliates against you for filing a safety complaint can be ordered to pay damages of at least $5,000 or twice your actual losses.
