§ 182.668 — Protection of Trade Secrets

Plain-Language Summary

Employers can protect trade secrets during workplace safety inspections and hearings. However, the need to protect trade secrets does not override an employee's right to know about hazardous substances in the workplace. Employees and their representatives can access safety information even if it involves trade secrets.

Practical Notes
Trade secret protection has limits when worker safety is at stake. An employer can ask that trade secret information be kept confidential during inspections and hearings, but cannot use trade secrets as a reason to withhold safety information from workers. The commissioner and review board must protect confidential information as much as possible.
