§ 244.30 — Cap on Incarceration for First-time Supervised Release Violations; Exception for Sex Offenders

Plain-Language Summary

When someone on supervised release violates their conditions for the first time, the commissioner can send them back to prison for no more than 90 days. This cap does not apply to sex offenders. The commissioner can exceed the 90-day limit if there are strong reasons to believe a longer period is needed to protect the public.

Practical Notes
The 90-day cap only applies to first-time revocations on the current offense. Repeat violators face no statutory cap. Sex offenders convicted under sections 609.342 through 609.3453 are completely excluded from this protection. The commissioner retains discretion to exceed 90 days with substantial and compelling reasons.
