§ 260D.01 — Child in Voluntary Foster Care for Treatment

Chapter 260D allows parents and social services agencies to voluntarily place a child in foster care when the child needs treatment for a mental illness, developmental disability, or related condition and cannot receive that treatment at home. The juvenile court has authority over these cases and must review them to make sure the placement is in the child's best interests. Parents keep legal custody of the child and must stay involved in planning and decision-making throughout the placement.

Practical Notes
This chapter is specifically for children who need foster care only because of treatment needs — it does not apply when there are child protection concerns. Parents who sign a voluntary foster care agreement retain their legal rights and must be kept involved in their child’s care and treatment planning. If child protective services issues arise, the case shifts to chapter 260C instead.
