§ 325D.02 — Application

This section explains which parts of the below-cost selling law apply to manufacturers versus retailers and wholesalers. Manufacturing rules are in one section, while selling rules are in others.
325D.02 APPLICATION.
Section 325D.03 shall apply only to the manufacture, production, or distribution of any commodity, article, goods, wares, or merchandise in general use or consumption. Sections 325D.04 to 325D.06 shall apply only to the selling, offering, or advertising for sale, giving away or offering or advertising the intent to give away of any commodity, article, goods, wares, or merchandise, in wholesale or retail trade.

Practical Notes
If you manufacture or produce goods, section 325D.03 applies to you. If you sell goods at retail or wholesale, sections 325D.04 through 325D.06 apply to you.
