§ 453.58 — City Powers

Plain-Language Summary

A city can exercise the powers of a municipal power agency on its own, without forming a separate agency. The city does this by passing a resolution. However, a city cannot bypass any requirement for an election before starting a new electric distribution system.

Practical Notes
Your city does not have to join with other cities to use these powers. A single city can act on its own by resolution to build or acquire generation and transmission facilities. But if the city does not already have an electric utility, it may need voter approval before starting one.
