§ 513.80 — Residential Real Estate Service Agreements; Unfair Service Agreements

This section makes certain residential real estate service agreements unfair and prohibited. A service agreement is unfair if it lasts more than one year and tries to bind future property owners, allows assignment without the owner's consent, creates a lien on the property, or automatically renews. Unfair service agreements are void, unenforceable, and cannot be recorded against the property.

Practical Notes
If a real estate service provider asks you to sign a long-term exclusive agreement that binds future owners of your home, it is illegal under this section. You do not have to honor it, and encouraging you to sign one is considered an unfair business practice. A consumer who is harmed can sue in district court and may also file a complaint with the attorney general or the commissioner of commerce. The statute of limitations for private lawsuits is six years after the agreement’s printed term expires.
