§ 550.175 — Execution on Real Property That Includes Homestead

Before a creditor can sell your home to pay a judgment, they must first get a court order. The court must determine the amount of your homestead exemption and whether the home's value exceeds the exemption plus any existing debts on the property. You have the right to designate which portion of your property is your homestead. If a non-debtor spouse also has homestead rights, the property generally cannot be sold at all.

Practical Notes
Your home has strong protections under Minnesota law. A creditor cannot simply take and sell your house – they must go through court, and in many cases the homestead exemption will protect you entirely.
