§ 563.01 — Court Fee Waiver; Authorization

Plain-Language Summary

This law lets people who cannot afford court fees start or defend a lawsuit without paying filing fees, costs, or security. You must fill out an affidavit showing your income and financial situation. People on public assistance, represented by legal aid, or with income below 125% of the poverty line are presumed to qualify.

Practical Notes
If you cannot afford court fees, ask the court administrator for a fee waiver affidavit form. If you qualify, the state pays for process serving, witness fees, and transcripts. If you later win money from the case, you may have to reimburse the waived costs. Lying on the affidavit is perjury.
