§ 563.02 — Inmate Liability for Fees and Costs

Plain-Language Summary

This law sets extra rules for prison inmates who want to file a civil lawsuit without paying court fees. Inmates must first use the prison's internal complaint process, provide detailed financial information including their inmate account balance, and may have to pay part of the filing fee. The court can dismiss frivolous or repeat lawsuits.

Practical Notes
If you are an inmate filing a civil lawsuit, you must exhaust the prison complaint process first and disclose your full financial situation. Even with a fee waiver, you may have to pay up to 50% of your inmate account balance. The court can dismiss your case early if it finds the claim has no basis in law or is a repeat of a prior dismissed case.
