§ 609.283 — Unlawful Conduct With Respect to Documents in Furtherance of Labor or Sex Trafficking

Plain-Language Summary

It is a crime to destroy, hide, take, or hold someone's passport, immigration documents, or government ID as part of labor or sex trafficking. If the victim is under 18, the penalty is up to 10 years in prison. In other cases, the penalty is up to five years. The victim's consent is not a defense.

Practical Notes
Traffickers commonly confiscate victims’ identity documents to control them and prevent them from leaving or seeking help. This law makes that specific conduct a separate crime. It applies to both real and fake documents. If you know someone whose documents are being held against their will, contact law enforcement.
