§ 609A.06 — Expungement and Resentencing of Felony Cannabis Offenses

Plain-Language Summary

This section creates the Cannabis Expungement Board to review felony cannabis convictions and determine whether they should be expunged or resentenced based on Minnesota's 2023 cannabis legalization law. The Board, which includes the chief justice, attorney general, a public defender, the corrections commissioner, and a public member, reviews case-by-case whether convictions for conduct now legal or reduced should be vacated, expunged, or resentenced. Courts then issue expungement or resentencing orders based on the Board's determinations.

Practical Notes
People with felony cannabis convictions may have their records automatically reviewed by the Cannabis Expungement Board without needing to file any petition. The Board holds public monthly meetings and considers victim and law enforcement statements before deciding. Expungement is presumed to be in the public interest unless there is clear and convincing evidence it would create a public safety risk. People currently serving sentences for qualifying felony cannabis offenses may be eligible for resentencing to a lesser offense, potentially resulting in earlier release.
