§ 62D.05 — Powers of Health Maintenance Organizations

This section describes what HMOs are allowed to do once they have a certificate of authority. HMOs can enter into health maintenance contracts, hire providers, contract for administrative services, accept payments from government and private sources, and offer supplemental benefits for out-of-network care. HMOs offering supplemental benefits must maintain extra financial reserves.

The supplemental benefits provision lets HMOs cover some out-of-network care, but they must keep extra money on hand to back those benefits. Medical Assistance recipients can apply to join any HMO approved for that program.
