2025 Session Last amended: 2024 session

§ 62D.04 — Issuance of Certificate Authority

Plain-Language Summary

This section explains how the Commissioner of Health reviews applications and issues certificates of authority to HMOs. The commissioner must check that the HMO can provide quality health care, is financially sound, and has proper quality assurance and complaint procedures. Only organizations with a certificate may call themselves an HMO. Nonprofit HMOs and local government HMOs must also participate in Medical Assistance and MinnesotaCare programs.

Practical Notes
The commissioner has 90 days to decide on an HMO application. Once approved, the HMO must continue meeting all standards or risk fines, suspension, or revocation. No organization may use the terms ‘HMO’ or ‘health maintenance organization’ without a certificate. Nonprofit HMOs must participate in government health programs like Medical Assistance, which is an important public service requirement.
