§ 70A.18 — Examinations

Plain-Language Summary

This section gives the commissioner the power to examine rate service organizations, insurers, and insurer groups whenever needed to enforce this chapter. The organization being examined must pay the costs. Employees and officers can be questioned under oath and must show all records. The commissioner can also accept examination reports from other states.

Practical Notes
The examination power is a key enforcement tool. The examined organization must pay for the examination, which creates a financial incentive to stay in compliance. The ability to accept other states’ examination reports also saves time and money when an insurer operates in multiple states.
