2025 Session Last amended: 2001 session

§ 14.126 — Committee Authority Over Rule Adoption

Plain-Language Summary

If both the House and Senate committees that oversee a subject area vote against a proposed agency rule, the agency cannot adopt that rule until the legislature finishes its next session. This gives the legislature a chance to address the issue. The committee vote must happen after the rulemaking notice is published but before the rule is officially adopted.

Practical Notes
This is a legislative check on agency rulemaking power. Both the House and Senate committees must vote by majority to delay a rule. The delay lasts only until the end of the next legislative session, not permanently. The Speaker of the House and President of the Senate decide which committees have jurisdiction over a rule.
