§ 14.26 — Adoption of Proposed Rule; Submission to Administrative Law Judge

Plain-Language Summary

When no hearing is required, the agency submits the proposed rule and supporting materials to an administrative law judge within 180 days. The judge has 14 days to approve or disapprove the rule based on its legality and whether the record shows a rational basis for it. If disapproved, the agency can fix the problems and resubmit within 30 days. If the agency misses the 180-day deadline, the rule is automatically withdrawn.

Practical Notes
The administrative law judge’s review is an independent check on the agency’s rulemaking. The judge reviews both the legal authority and whether the record supports the need for and reasonableness of the rule. If the rule is disapproved twice, it is withdrawn. The agency pays the costs of the review process.
