§ 14.386 — Procedure for Adopting Exempt Rules; Duration

Exempt rules (those the legislature excluded from normal rulemaking) must still be approved by the Revisor, signed by the agency, approved for legality by the Office of Administrative Hearings, filed with the Secretary of State, and published in the State Register. Exempt rules are only effective for two years and then expire.

Practical Notes
Even though exempt rules skip the public hearing process, they still must be reviewed for legality and proper form. They automatically expire after two years. Game and fish rules and certain other types are excluded from this section. Check whether a specific exempt rule is still within its two-year validity period.
