§ 142A.05 — Rulemaking

Plain-Language Summary

This section gives the commissioner the power to adopt rules needed to carry out the department's responsibilities. The commissioner must update existing Minnesota Rules to reflect the transfer of duties from other agencies. The commissioner has 36 months to begin the formal rulemaking process.

Practical Notes
Before changing rules that were previously managed by the departments of human services, education, health, or public safety, the commissioner must get approval from those agencies’ commissioners. This ensures a smooth transition when programs move to the new department. All rulemaking must follow the standard procedures in Chapter 14.
