§ 142B.11 — License Application After Change of Ownership

This section explains what happens when a licensed child care or foster care program changes ownership. A license cannot be transferred to a new owner. The new owner must apply for a new license at least 90 days before the change. There is also an emergency process when a license holder dies or becomes unable to operate.

Practical Notes
If you are buying or taking over a licensed program, you must apply for your own license well in advance. No change in ownership occurs if at least one controlling individual has been with the license for the past 12 months. In emergencies like the death of a license holder, a new party can request to take over operations immediately while applying for a new license.
