§ 142B.20 — Hearings

Plain-Language Summary

This section describes the hearing process for license holders who appeal licensing sanctions, denials, or disqualifications. Hearings are conducted by an administrative law judge, who makes a recommendation to the commissioner. The commissioner issues the final order and is not bound by the judge's recommendation.

Practical Notes
At a hearing, you can have a lawyer, call witnesses, and cross-examine the other side’s witnesses. If your license was revoked, you cannot get a new license for five years. If your application was denied, you must wait two years before reapplying unless you can show a substantial change in circumstances. The commissioner’s final order can be appealed to court.
