§ 149A.91 — Preparation of Body

Plain-Language Summary

Anyone who handles an unembalmed body must use universal precautions to prevent disease transmission. Embalming may only be done by a licensed mortician. If the family does not want embalming, the body must be kept refrigerated at 40 degrees or below until final disposition.

Practical Notes
Embalming is not required in most cases. Refrigeration is a lawful alternative. If you choose not to embalm, the funeral provider must refrigerate the body. Final disposition must happen within a reasonable time unless the body is properly preserved.
