§ 515B.1-102 — Applicability

Plain-Language Summary

Determines which common interest communities are governed by the Minnesota Common Interest Ownership Act (MCIOA). The Act fully applies to condominiums, cooperatives, and planned communities created on or after June 1, 1994. Older communities created under chapters 515 or 515A are subject to specific listed sections.

Practical Notes
Whether your condo or HOA is governed by this chapter depends on when it was created. Communities formed after June 1, 1994 are fully covered. Older condominiums created under chapter 515 are subject to a long list of specific MCIOA sections (including rules on association powers, assessments, liens, and resale disclosures). Older cooperatives and planned communities can voluntarily elect to be subject to MCIOA by recording an amended declaration.
