§ 611.45 — Competency Findings

Plain-Language Summary

The court must rule on a defendant's competency within 14 days of receiving the examiner's report, or within 30 days after a contested hearing. If the defendant is found competent, the criminal case resumes. If found incompetent, the case is suspended. For misdemeanors, charges must be dismissed. For gross misdemeanors and targeted misdemeanors, charges must be dismissed within 1-2 years. For felonies, charges must be dismissed within 3-5 years, with exceptions for serious violent crimes.

Practical Notes
If you are found incompetent, the timeline for dismissal of charges depends on the severity of the charge. Misdemeanor charges are dismissed right away. Gross misdemeanors and targeted misdemeanors have 1-2 year limits. Felony charges can remain for 3-10 years depending on the maximum sentence. Charges involving violent crimes like murder may never be dismissed due to incompetency.
