§ 62D.17 — Penalties and Enforcement

Plain-Language Summary

This section sets penalties for HMOs that violate the law. The commissioner can levy fines of up to $25,000 per violation. Knowingly violating the law or submitting false information is a misdemeanor. The commissioner can also issue cease and desist orders and seek injunctions. Half of any fine collected must be distributed to affected enrollees, unless doing so would be impractical.

Practical Notes
The commissioner has multiple enforcement tools including fines, cease and desist orders, and the ability to seek court injunctions. Affected enrollees may receive a share of fines collected. Before taking formal action, the commissioner can hold informal conferences to try to resolve issues. HMOs have the right to request hearings on fines and cease and desist orders.
