§ 62D.15 — Suspension or Revocation of Certificate of Authority

Plain-Language Summary

This section lists the reasons the Commissioner of Health can suspend or revoke an HMO's certificate of authority. Grounds include operating contrary to the law, issuing noncompliant coverage documents, being unable to provide services, being financially unsound, failing to handle complaints, or misleading advertising. During suspension, the HMO cannot enroll new members. After revocation, the HMO must wind down its business.

Practical Notes
If an HMO is suspended, it cannot sign up new members but must continue serving existing ones. If revoked, the HMO must stop operating, though the commissioner can allow limited continued operation to protect enrollees. These enforcement tools protect consumers from poorly run HMOs.
