§ 62L.12 — Prohibited Practices

This section prohibits health carriers from selling individual health plans to employees of small employers that meet participation requirements, with several exceptions. Exceptions include conversion policies, coverage for unaffordable employer plans under the ACA, health savings account high-deductible plans, and situations where the employer does not contribute to or administer the individual plan. Employers are also prohibited from steering employees away from group coverage based on health status. Insurance companies cannot require small employers to buy other insurance products as a condition of getting health coverage.

Practical Notes
If you are a small employer that meets the participation and contribution requirements, your insurance company generally cannot sell individual policies to your employees instead of group coverage. However, employees may buy individual plans if the employer does not contribute to or administer them. Employers must not steer employees away from group coverage based on their health. Insurance agents who break apart small groups to sell individual policies face disciplinary action.
