§ 259.47 — Direct Adoptive Placement

Plain-Language Summary

Governs direct adoptive placements where a birth parent places a child directly with adoptive parents rather than through an agency. Requires court-approved preadoptive custody, provides birth parents with rights to counseling and legal counsel at the adoptive parents' expense, and establishes consent procedures.

Practical Notes
In a private or direct adoption, the birth parent chooses the adoptive family without going through an agency. The adoptive parents must get a court order before the child is placed in their home, pay for the birth parent’s counseling and legal representation if requested, and have the placement supervised by an agency. Birth parents have ten working days after signing consent to change their mind.
