§ 507.071 — Transfer on Death Deeds

Plain-Language Summary

A transfer on death deed (TODD) lets a property owner name someone to receive their property when they die, without going through probate. The deed must be recorded before the owner dies and can be revoked at any time. Both spouses must sign if the property is a homestead.

Practical Notes
TODDs are a popular estate planning tool in Minnesota. They avoid probate but the property is still subject to the deceased owner’s debts, including medical assistance claims. The beneficiary should apply for a clearance certificate from the county after the owner’s death.
