§ 609.229 — Crime Committed for Benefit of Gang

Enhances penalties for crimes committed for the benefit of or at the direction of a criminal gang. A felony committed for a gang adds 5 years to the maximum sentence, or 10 years if the victim is under 18. A misdemeanor or gross misdemeanor committed for a gang becomes a felony.

A criminal gang is defined as an ongoing group of three or more people with a common name or symbol that engages in a pattern of criminal activity. The enhancement requires proof that the defendant intended to promote, further, or assist criminal conduct by gang members. The 5-year enhancement cannot be applied to first-degree murder charges.
