§ 142E.18 — Fair Hearing Process

Plain-Language Summary

This section gives families and providers the right to a fair hearing when they disagree with a decision made by the county about child care assistance. The hearing process follows the same rules as other public benefit hearings in Minnesota. Families can request a hearing within 30 days of receiving a notice of an adverse action.

Practical Notes
If a family or provider receives a notice that benefits are being reduced, terminated, or denied, they should request a fair hearing right away to preserve their rights. Filing for a hearing before the effective date of the action may allow benefits to continue at the current level during the hearing process. Families can represent themselves or have an advocate help them at the hearing.
