§ 171.306 — Ignition Interlock Device Program

Plain-Language Summary

Minnesota's ignition interlock program lets people whose driver's license was revoked for a DWI get a restricted license if they install a device that tests their breath before the car will start. The device prevents the car from starting if the driver's breath alcohol level is 0.02 or higher.

Practical Notes
When this applies: After a DWI-related license revocation, cancellation, or denial, when the person wants to get a restricted license to drive. Who this affects: Minnesota drivers whose licenses were revoked for impaired driving offenses, including DWI and criminal vehicular operation. Participants must be 18 or older. Key points: The device must be installed on every vehicle the participant drives, and the participant pays for it. Manufacturers must offer discounts to low-income participants. Tampering with or bypassing the device is a misdemeanor. If the device registers a breath alcohol level of 0.02 or higher, the program period is extended. Program violations add 180 days to 545 days to the revocation period. Participants must also complete any recommended substance use treatment. Location tracking on the device is not allowed without a court order.
