§ 609.115 — Presentence Investigation

Plain-Language Summary

Requires a presentence investigation report before sentencing for all felony convictions. The report covers the defendant's background, criminal history, the harm caused, and victim information. Courts may also order the report for misdemeanors and gross misdemeanors. Chemical use and gambling assessments may also be required.

Practical Notes
The presentence report is shared with both the prosecution and defense before sentencing, though confidential sources may be protected. For felonies, a sentencing worksheet must be completed. If alcohol or drugs contributed to the crime, a chemical use assessment is required. Courts must also ask whether the defendant is a military veteran.
