§ 609.106 — Heinous Crimes

Plain-Language Summary

Requires life imprisonment without the possibility of release for certain first-degree murder convictions, including murder during a kidnapping, murder involving a weapon or assault, and murder by someone with prior heinous crime convictions. Offenders under 18 receive life with the possibility of release instead.

Practical Notes
Heinous crimes include first- and second-degree murder, first-degree assault, and criminal sexual conduct committed with force or violence. A prior conviction counts only if the person was discharged from that sentence within the last 15 years. Juvenile offenders cannot receive life without release under this section.
