§ 609.268 — Injury or Death of Unborn Child in Commission of Crime

Anyone who causes the death or serious injury of an unborn child while committing a felony or certain other crimes is guilty of a separate felony. Causing the death carries up to 15 years in prison and a $30,000 fine. Causing great or substantial bodily harm carries up to 10 years and a $20,000 fine.

Practical Notes
This law adds extra criminal liability when a felony or specified crime results in harm to an unborn child. It does not apply if the defendant is already being charged under the specific murder or assault of unborn child statutes. The child must be born alive for the injury charge to apply.
