§ 609A.02 — Grounds for Order

Records can be sealed for dismissed cases, successful diversions, misdemeanors (2-year wait), gross misdemeanors (3-year wait), and certain felonies (4-5 year wait). Records for sex offenses requiring registration cannot be expunged.

Key points: The waiting period is measured from the date you completed your sentence (not the conviction date). If your case was dismissed or you completed diversion, the waiting period is shorter. Not all felonies qualify. Offenses requiring sex offender registration can never be expunged. The list of eligible felonies includes certain theft, forgery, property damage, and drug offenses.
