§ 260C.178 — Emergency Removal Hearing

Plain-Language Summary

When a child is taken into custody, the court must hold an emergency hearing within 72 hours (not counting weekends and holidays) to decide if the child should stay in custody or be returned home. The court must also determine whether the agency made reasonable efforts to keep the family together before removing the child.

Practical Notes
This hearing is critically important for parents. You have the right to be there and to have a lawyer. The court must consider placing the child with the other parent or a relative before ordering foster care.
