2025 Session Last amended: 2025 session

§ 609.101 — Surcharge on Fines, Assessments; Minimum Fines

Plain-Language Summary

Requires minimum fines for people convicted of assault, sexual assault, and controlled substance crimes in Minnesota. The minimum fine is 30 percent of the maximum allowed by law. Most of the fine money goes to local victim assistance programs. Also requires surcharges on all criminal and traffic fines.

Practical Notes
If you are convicted of assault, domestic assault, sexual assault, or a drug crime, the court must impose a fine of at least 30 percent of the maximum, even if you cannot afford it. This is in addition to any jail time, probation, or restitution. Seventy percent of these fines go directly to local victim assistance programs. The fine cannot be waived, though the court may set up a payment plan.
